2024 ACA Reporting Guidance for Employers

Employers subject to Affordable Care Act (ACA) reporting under Internal Revenue Code Sections 6055 or 6056 should prepare to comply with reporting deadlines in early 2025. For the 2024 calendar year, covered employers must:

  • Furnish statements to individuals by March 3, 2025 (an alternative method of furnishing statements to covered individuals is available in certain situations); and
  • File returns with the IRS electronically by March 31, 2025 (or by Feb. 28, 2025, if filing on paper). Employers that file at least 10 returns during the calendar year must file electronically.

 

Guidance from our Carrier Partners:

Aetna

Aetna will prepare and file 1095-B tax forms for employers with 2 to 50 eligible employees and distribute via the member wbsite. 

So there are no delays, employers should ensure group information on the bill exactly matches the information clients use to file taxes with the IRS. This includes group name and Tax ID.

Aetna will not file 1095-B forms on behalf of employers with 51 or more eligible employees.

Anthem

Anthem is required to file tax forms 1095-B and 1094-B electronically with the IRS for all fully insured plans. Anthem must also mail tax form 1095-B to members.

Fully insured and Administrative Services Only (ASO) groups with 50 or more full-time employees are considered Applicable Large Employers (ALEs) by the IRS and are required to file tax form 1095-C along with tax form 1094-C.

Anthem will create tax forms 1095-B and 1094-B forms for Small Group Multiple Employer Welfare Arrangement (MEWA) and Small Group Anthem Balance Funding (ABF) groups. They will post these forms to the EmployerAccess portal in early February.

Cigna

Self-Insured (ASO)

  • Small employer (less than 50 FTE)- Employer’s responsibility to file the 1094-B and Parts I, III and IV of the 1095-B form.
  • Large employer (50+ FTE)- Employer’s responsibility to file the 1094-C and 1095-C forms.

Fully-Insured

  • Small employer (less than 50 FTE)- Insurer’s responsibility to file the 1094-B and 1095-B forms. This fulfills the group’s reporting requirements.
  • Large employer (50+ FTE)- Insurer’s responsibility to file the 1094-B and 1095-B forms.

Employers are responsible for filing the 1094-C and Parts I, II, and III of the 1095-C for each employee offered coverage. ASO clients can leverage the following Team to assist them with questions around reporting/filing:

Employees who request their 1095B can find them on myCigna.com by January 31. They aren’t physically placed in the mail. To access the 1095-B form:

  1. Hover on Claims in the main menu bar.
  2. Click Form Center.
  3. Click tax forms and documents.
  4. Click Download a 1095-B Tax Form from the list that appears.

UnitedHealthcare

Effective November 1, 2024, all Level Funded plans will include access to Mineral™ solutions, including select premium products. Mineral takes the guesswork out of HR and compliance, and starting January 1, 2025, an Affordable Care Act (ACA) compliance and reporting solution will be included as part of the premium Mineral solutions for UnitedHealthcare clients.

This enhancement gives access to:

  • ACA reporting
  • Delivery of Internal Revenue Service (IRS) Forms 1095-Band C to employees
  • Electronic transmission (E-Filing) to the IRS
