HealthEquity Data Breach

Applies to Sentara Health Plans (VA) and Blue Cross Blue Shield Plans (NC)

In late June, our carrier partners at Sentara and BCBSNC were notified of a data breach from their Health Savings Account (HSA) custodian, HealthEquity. After receiving an alert on March 25, 2024, HealthEquity became aware of a systems anomaly that required extensive technical investigation and ultimately resulted in data forensics that concluded on June 10, 2024. Through this extensive work, they discovered unauthorized access to or disclosure of protected health information and/or personally identifiable information.

HealthEquity is sending an email notice and Frequently Asked Questions to impacted employer groups notifying them of the breach. HealthEquity plans to send an email notification to impacted employees around August 9, 2024. If employees do not receive a letter, HealthEquity determined that their personal information was not impacted. HealthEquity has arranged credit identity monitoring services for a period of two years, free of charge, through Experian.

How Employers* Should Handle PCORI Fees

The ACA imposes a fee on employers with a Health Reimbursement Arrangement (HRA) or a self-insured plan to fund the Patient-Centered Outcomes Research Institute, also known as Comparative Effectiveness Fees. This Fee is always due by July 31 of the calendar year following the end of the plan year. For plan years ending in 2023, the PCORI fees are due by July 31, 2024.

*PCORI Fees apply to Self-Insured Plans, Health Reimbursement Arrangements, Including Qualified Small Employer HRAs (QSEHRAs) and Individual Coverage HRAs (ICHRAs).

Retaliation – Reducing Your Risk

If an HR on Mic episode on retaliation seems familiar, it's because Barbara and Corbin discussed it before. It’s that important. About 55% of the EEOC actions that employees file against employers include a retaliation component.

This newest retaliation episode provides more practical prevention guidelines and real-world examples. Whether you’re dealing with FMLA, the ADA, or any one of the many legally protected activities, don’t let retaliation complicate your life. Listen here!
