Deadline for Employers to Receive MLR Rebates is Approaching

Employers with insured group health plans may soon receive a medical loss ratio (MLR) rebate from their health insurance issuers. Issuers who did not meet the applicable MLR percentage for 2023 must provide rebates to plan sponsors by September 30, 2024. These rebates may be in the form of a premium credit or a lump-sum payment. Click here to learn more about MLR rebates.

Our Towne Benefits Compliance Specialist, Corbin Granger, recently hosted a webinar on How Employers Should Handle MLR Rebates. You can view the recorded webinar on our website or YouTube if you missed it.

Gag Clause Attestations due December 31, 2024

Under the Consolidated Appropriations Act (CAA) group health plans and health insurance issuers are prohibited from entering into agreements with providers that prevent enrollees, plan sponsors, or referring providers from seeing provider-specific cost and quality data. Plans and issuers must annually attest to CMS that they are in compliance with all requirements, known as the Gag Clause Prohibition Compliance Attestation (GCPCA). Plans and issuers must attest no later than December 31, 2024.

Each carrier has different processes for collecting and submitting gag clause information. We will continue to update this page on our website as the information becomes available.
